1. Definitions
In this transportation terms agreement, "Company," "We," "Us," or "Carrier" refers to L&M Trucking and Hauling LLC, headquartered at 921 Findlay St, Cincinnati, OH. "Shipper," "Client," or "Customer" refers to the entity or individual requesting logistics services.
2. Quotes and Rates
All service quotes provided by L&M Trucking are based on information provided by the Shipper at the time of inquiry.
- Quotes are valid for a period of 15 days from the date of issuance unless specified otherwise.
- Final rates are subject to change based on actual equipment required, fuel surcharges at the time of transport, and any unforeseen detention time.
- Specialized handling or expedited requirements not disclosed during quoting will result in additional charges.
3. Payment Terms
To maintain our standard of excellence in logistics, L&M Trucking and Hauling enforces strict payment protocols:
Invoices are due Net 30 from the date of delivery unless otherwise established in a signed credit agreement. Late payments are subject to a 1.5% monthly interest charge. We accept electronic transfers, corporate checks, and major credit cards (subject to a processing fee).
4. Carrier Liability and Cargo Claims
L&M Trucking and Hauling maintains industry-leading insurance coverage to protect your assets. Our liability for loss or damage to cargo is governed by the Carmack Amendment (49 U.S.C. § 14706).
Claim Window
Claims must be filed in writing within 9 months of delivery.
Maximum Liability
Standard liability is limited to $100,000 per shipment unless higher value is declared and additional fees paid.
5. Shipper's Obligations
The Shipper is responsible for ensuring that all cargo is properly packaged, marked, and labeled for safe transit. The Shipper must provide accurate weight, count, and dimensions. Failure to disclose hazardous materials or overweight loads may result in immediate termination of the transport and penalty fees.
6. Governing Law
This service agreement and any disputes arising from it shall be governed by the laws of the State of Ohio. Both parties agree that the courts in Hamilton County, Ohio, shall have exclusive jurisdiction over any legal proceedings.
